We Don't Stand For Corrupt Mortgage Companies
Mortgages today are not like those handled by banks in years past. During the real estate boom, mortgage companies made a lot of imprudent loans and then bundled mortgages according to risk and sold them as securities. These bundles were repeatedly sold and transferred to other companies, often without following proper procedures, causing many notes and mortgages to be so far removed from the original company that often the investors can't find the legal paperwork required by courts to prove that they have standing to maintain the foreclosure suit.
When we handle foreclosure cases against mortgage companies, we always demand that they present documents proving that they own your loan. Often, they cannot produce them. Our firm can quickly identify companies that are not following federal law and often prevent them from pursuing litigation.
"While I was at a hearing on another matter, I overheard a case where two elderly, handicapped women were being evicted from their home by a predatory lender. I immediately volunteered to represent the ladies pro bono. I found irregularities in the lender's practices and the case was dismissed." — Tom J. Manos
A Quiet Title May Be Possible
An action to quiet title is to establish ownership of property. In mortgage foreclosure situations, a quiet title action may be necessary if the mortgage has improperly changed hands and no one legitimately holds the mortgage any longer. If the lender cannot establish standing to foreclose, it is possible that the homeowner may be able to quiet title to the property and extinguish the mortgage. At Tom J. Manos, P.A., we will evaluate all of your options to try and keep you in your home.
